The Conflicts Between Spouses's Right To Privacy And Spouses's Right To Know

The Right to Privacy and the Right to Know are basic rights in the current legal society,which aer important standards to measure democratic development in a country. Nevertheless, Chinese constitution has not clearly stipulated the two rights, and there are also lack of provisions in laws and statutes relating to the two rights. Conflicts often happen between the Right to Privacy and the Right to Know,especially in between the husband and wife the conflicts become more complex, as each of the spouses has not only independent personal rights but also common intersts. The paper is divided into four parts totally:The first part, to introduce the generating, development and history actuality of the Right to Privacy and the Right to Know, discuss the concepts of the two rights , make concrete defines of the two rights based on the research on the various theories..The second part, to introduce through some typical cases the conflicts between the spouses`s right to privacy and spouses`s right to know which will be solved in this paper.The third part, to analyses the reasons that caused the conflicts between spouses`s right to privacy and spouses`s right to know,find out the reasons and rules of the conflicts.The fourth part, to make a conclusion on the principles in solving the conflicts between spouses`s right to privacy and spouses`s right to know based on the research of the most of specialists,put forward the images in solving the problems.
