| There have been significant changes in the world economical and international status. Because of the imbalance between the difference trade bodies, it makes the international trade disputes often aroused. In the agricultural trade field, the disputes are more intricacy. Being the specific foundation and tactic status in the national economy, the agricultural product trade has been paid more and more attention to by every county in the world. For protecting one's agricultural trade benefit, many countries especially developed county also have given various supports and subsidies to the domestic production and international trade of agricultural products. Among these, the measure they usually took is the export subsidies to the domestic agricultural products. The subsidies actually embody the unfair trade because it can influences the agricultural products prices in the world market, and it can produces disadvantage results to the competition power of other country.The WTO, established on Jan 1, 1995, now has become into one of the most important and influence international organization. Its long terms destination is "to establish a fair, market oriented agricultural products commercial system" and "in the certain period times substantiality cutting off the support and protection to the agriculture step by step, consequently correct and avoid the limits and distortion in the market of the world agricultural products'". Stick out a mile, the subsidies to the agricultural products export run counter to the fair trade system what WTO proposed, so must be forbidden.The export subsidies are taken as the key in this dissertation, and from four aspects the law of agricultural export subsidies in the WTO framework was expatiated. Above all, as historical background of the existing agricultural subsidies system in the WTO framework, it reviews the evolution of the agricultural export subsidies system, and takes emphasis on depicting the export subsidies in the framework of the GATT (General Agreement on Tariffs and Trade), the involved prescribe about the subsidies of the agricultural products in the《the 1979 Subsidies Code》and the《the Agreement on Subsidies and Countervailing Measures》. The correlation cases are evaluated. Next , in allusion to the rule, acceptance and execution of the subsidies on the agricultural products export ,the actual rule about the system of the subsidies in the《the Agreement on Agriculture》are expatiated in detail. Again, according to the Chinese status, the simple analyses have been worked out about the system of the agricultural export subsidies including the influence to the domestic agricultural production and strategy would be taken. Finally, the direction and expectation of the system about the agricultural export subsidies were discussed.For the game rule about the international economy, though according with the socialization production in some aspects, but as a whole it is constituted dominantly by the west developed country, they are beneficiary in the globalization of the economy. So for the irrationality rules, we not only can't accept, but also should opposed about those rules united the most developing country, and it is abolished or modified through the establishment of the new rule of the international economy. In the export subsidies of the agricultural products, though all of the export subsidies will be abrogated before the 2013 through the hardworking of the members of the WTO, but there also have a long way to go. We must clearly realize that it is a long-term and arduous engineering in establishment of the fair, market oriented commercial framework of the agricultural products within the range of whole world .We should actively participate in the constituting and clarifying of the agricultural rule for rather vindicating the agricultural benefit of our county. |
