Study Of The Legislation Of Industrial Investment Fund

Industrial Investment Fund, the name of the private equity fund called in China, as an important form of investment funds, plays an important role in promoting the development of the social economy. The international private equity funds have got high revenue from the investment in China; however the development of the Chinese industrial investment fund is rather slow. In order to promote the development of the economy of our country, we should pay more attention to the development of industrial investment fund.This paper, which is consisted of two parts, studies the industrial investment fund in perspective of law on the basis of analyzing its characteristics and application mechanisms.The first part introduces the general overview of industrial investment fund from the concept, the characteristics and application mechanisms, the function and the current development in our country.The second part has a study on the legislation of the industrial investment fund of our country. This part begins to study with the relationship between the economy and the law which means that the industrial investment fund should be regulated by law. After analyzing the legislation of other countries and regions, the conclusion is that our country should legislate an industrial investment fund law which regulates the industrial investment fund systematically and suits to the current national condition of our country. The efficiency and safety must be the value of the law. The principles of protection of investors and supervision according to law are necessary to the law. In all, we should pay more attention to the supervision of the method of raising fund, the form of organization, and the obligations of the managers and trustees.
