The Adult Guardianship System is a legal system to supervise and protect human body rights & property rights of the adult, who are short of judging ability. With the development of society, the trend of aging of population is increasingly serious. The problems such as protecting legal rights of the old, raising their living quality etc. have caused widespread concern of international society. With the problem of aging of population, the system of law has to face a very important point in the course of design, which is to enhance the legal protection of the old lack of awareness of self-preservation. The traditional adult guardianship system displays unpopular more and more when it is facing the new social problem. At the same time, the principle of guardian system has taken great change with the rise of idea for human rights. Therefore many countries in succession carried on overall reform to the old guardianship system from principle to structure. However our guardianship system has serious blemish with inborn disadvantage for historic reason, so it doesn't develop the function that should have at all in law practices. In the present social background with huge variety, it goes necessary to reform the adult guardianship system. On the other hand, it doesn't attach great importance to the meaning of reforming the guardianship system and it still needs to be considered which are drawn up in the civil law draft. The writer is going to do a further research on the adult guardianship system with the expectation of making the guardianship system of our country improved and sound. Viewing the historical development of adult guardianship system, this thesis mainly introduces its reform trend and concrete circumstance of the advanced countries all over the world. Combining to analyzing present condition and background change of the system in our country and absorbing the reform experience from the nations of the world , the article puts forward the suggestion to re-build our adult guardianship system and gives opinion for its conveyance system with the purpose of making an exertive and better function in law practice.
