Under the market economy, there are more and more parties to marriage participate in various kinds of economic activities, and the civil trade activities are frequent. The parties are engaged in such activities as producing, managing, financing, debt consumption ect. The thesis is formed by foreword and the four parts followed, about 360,000 words of full thesis. The thesis adopts comparative analysis technique and demonstration analysis technique, combining theory with the practice of using the law in our country, centering on the rational thinking of the matrimonial debts system, this author will carry on the discussion about the basic theory of the matrimonial debts system. On the basis, then make a self-criticism to our regulations of matrimonial debts, expecting to set up more perfect matrimonial debts system in the future.The whole thesis consists of three parts: preface, main part, and ending. This chapter studies on the matrimonial debts system internal and external, and then carries on comparative analysis.Chapter3: The advantage and disadvantage of current matrimonial debts system in China. On studying our marriage law, the advantages of current matrimonial debts system in China: repayment of the debts conforms to debt law better; improve the law status of contractual debts; enhance the safety of transaction. At the same time, the disadvantage of current matrimonial debts system of in China: distinguish the matrimonial debts; protect the creditor; the quote obligation assignment.Chapter4: The perfection of China matrimonial debts system. To protect the safety of transaction, the chapter makes a tentative proposal that several principles and systems should be established while perfecting matrimonial debts of our country legislates in procedure and entity.
