On Social Stratification And Legal Supply

Social stratification is a kind of inevitable social phenomenon, which not only has one good side, but also has another bad side. How to guide social stratification and avoid unreasonable social stratification is always emphasized in theory research. Some researches on social stratification are engaged in from the angle of sociology, these researchers are focused on the middle classes, and it can strengthen social stability, so this kind of researches insist on developing middle classes and deceasing the low classes and upper classes. But there are few researches on social stratification from the law point of view. In fact, law is necessary in social stratification research. Society managers supply proper laws, and guide social stratification according to laws. It is a popular and effective way. This article is just to probe the relation between social stratification and law supply, and how both of them are affecting each other. We can find a good road to construct socialist harmonious society through this way.This article relies on dialectical materialism and history materialism, uses literature analysis and practical research methods, and researches the basic theory and the mutual action mechanism about social stratification and law supply. And the article also analysis present social stratification of our society, points its problems. The correct ways are to supply proper laws, revise and stop some laws out of time. We can use laws to affect and control social stratification, and hold back irrational social stratification, avoid society conflicts, keep social stability. We should use not class struggle but laws to resolve social stratification.This article is made of five sections. The first section is about some basic theories, introducing the concepts, characters and functions on social stratification and law supply. The second section is about to probe the relation on social stratification and law supply, and contrasts some relative concepts, such as inequality in social stratification and every people is equal in the face of law. The third section is about to introduce social stratification in our society today, pointing some problems. The forth section analyzes some problems about the mutual action of social stratification and law supply, such as the large gap between the poor and the riches, the slow development in countryside. The fifth section is this article's stress. The article proofs that the socialism harmonious society has a rational social stratification, and it is also rule by law. So we should make social stratification and law supply mutually act well, and construct our socialism harmonious society in which laws are implemented well and social classes are disintegrated rationally.
