| As one of the unitied international laws, the rule that the higher price offerer gets the Stuff is the most important auction rule. Although our country's "Auction Law" has not explicitly stipulates such a rule, it is established through such provisions as "auction definition" and "auction deal stipulation". But it is precisely because of these ambiguous Stipulations that it does not contorm with the other legal rules, resulting in the frequent conflicts in the auction practice. Studying the nature and effective scope of high price results, the paper illustrates "the same high price" rule and "purchase priority" rule which contraclict with this legal rule and then explores the conflicting origin on the basis of sound understanding of the legal system. In hope of putting forward the proper negotiation legal suggestions which could put into practice easily.The paper is composed of three parts. The first part introduces the auction definition as well as the effective scope of the rule that high price offerers gets the auction stuff. In the second part, the author illustrates the definition of "the same high price", analyses the conflicting reason and finally puts forward the negotiation ways. The third part presents the definition, nature and application of "purchase priority", and then on the basis of whichbrings forward the negotiation solution ways in case of conflicts. |
