The Important Issues And Improvement Of Reeducation-through-Labor System

It's more than forty years that the Reeducation-through-Labor System has been existing. It plays an active role to some extent such as consolidating our socialism regime, maintaining the public security and preventing or decreasing those slight crimes. However, with the advancement of the principle of democratic and role of law, many disadvantages of this system are emerging gradually. We can see the widening of its objects, the confine of zone which is disaccord with equality of law, the lack of judicial process at the side of examining and approving, which has a serious impact on protection of civil rights and human rights, and also, the shortage of characteristic in execution, etc. The target of my paper is to talk about these disadvantages of Reeducation-through-Labor and make suggestions for the improvement of this system. We can define a character more clearly in order to point out the way of innovation, which, can named reeducation for the slight crime with a short time restrict by penal way but not penalty. The first chapter of my paper is to show the important issues of this system and then make a conclusion. The second chapter tries to define the character of Reeducation-through-Labor System, and then establish a system of penal and judicial way. The last three chapters of this paper are scientific reconstructions I try to make out of the system, which include three aspects, entity, process and execution, which is the keystone of this paper.
