Reeducation through Labour system with Chinese characteristics, as the legal means of more than 50 years, while contributing a lot to our economic and social development, has betrayed many defects and drawbacks that don't match with modern Law construction. Nowadays, with the fast development of our social law construction system, it is imperative to reform and perfect Reeducation through Labour System.This thesis is composed of three parts:Part one:the history of Reeducation through Labour system: this part gives a detailed review of historical background and development of Reeducation through Labour system in china. According the time order, this part illustrates its historical development track and tortuous experience from the Legislation Angle and the closed relationship between its development and social political environments and its political color and times characteristicsPart two:Status and drawbacks of Reeducation through Labour system:this part lists the legislative situation of Chinese Reeducation through Labour system and its related provisions in content. It affirms that Reeducation through Labour system plays an active role in social and political stability, public order, social and economic development, prevention and reduction of crime, education and saving minor illegal crime person and so on. At the same time, this part focuses on the status and drawbacks in legislative implementation process and the root and harm of its status and drawbacksPart three: imagination of reconstruction Reeducation through labor system:This part inductively introduces the critical ideas on whether there should be Reeducation through Labour systemic or not, and gives imagination on the reform of Reeducation through Labour system.
