The Research On Unconstitutional Censorship In China

The enforcement of Constitution is the precondition of the policy of'administering a country in conformity with legal provisions'. Unconstitutional censorship is an effective system that ensures the enforcement of Constitution. However, many problems exist in the current unconstitutional censorship, which prevents the system from exerting its proper influence, and hinders the unification of socialist laws and the progress of the construction of legal system as well. On the basis of summarizing and learning advanced foreign legal system, this paper endeavors to propose some suggestions on reforming unconstitutional censorship in China, and creating an effective unconstitutional censorship which is in accordance with national conditions by analyzing the typical model of unconstitutional censorship in the world. Besides, the nature, position and authority of the constitutional court have also been discussed in this paper.
