China is the world's largest tobacco producer, is also the largest tobacco consumer, it is unassailable that the tobacco industry has an important position in the national economy. This can find footnote for the state to implement its monopoly–the People's Republic of China Tobacco Monopolization Law stipulates that tobacco industry obey the monopolization management system whose slogan is"seek unity of leadship; vertical administration; monopoly and exclusive management". Focus on the state management plans as well as it's intensity of macroeconomic regulation and control is regarded as the overall characteristics that make it unique from other industries.As implementation of a national economic system, but also a national legal system, the existence of tobacco monopolization system has some historical heritage. However, our current tobacco monopolization system has its shortage. While in the process of implementing the system throughout the tobacco monopoly, there some problems existed between the central and local government such as the main decision-making, intervention powers and roles of the conflict. Entry to the WTO, China's tobacco industry is facing unprecedented pressure and urgency, since after accession to the WTO our government insists on retaining the tobacco monopoly system, the starting point certainly is not to protect inefficient tobacco industry, because China's tobacco industry does not have the ability to contend with foreign tycoon, China's government hope recurring to this system, enhanced our overall competitiveness of the tobacco industry. Once this objective was achieved, the system is no need. In other words, "Is to abolish the monopoly of monopoly", it is also can be understood as the orientation for our existing tobacco monopolization system. It clearly indicates that the Chinese tobacco industry is in the process that the exclusive monopoly is abolished step by step. On this foundation, based on the conditions of our country, the author takes the European Union and Japan as the comparison cases of tobacco control model for research, cognizing its forms, means and the experience of development and change; and then puts forward the model and the aim of how to innovate our country's tobacco monopolization system.
