A Study On The System Of Administrative Letters And Visits From The People

The system of Administrative Letters and Visits from the People (ALVP) has the function of "understanding the will of people". It is a way through which masses directly communicate own complaints or opinions and suggestions to the authority concerned to achieve the goal of perfecting social system. With the increase of rate of ALVP year by year, this system has been arousing concern of the different circles. Unfortunately, very few information concerning ALVP is available at present. This text is author's deep exploration for the system of letters and visits from the people (LVP) basing on theoretical study and practical investigation. Through the introduction to the concept of LVP it extends to meaning of concept of ALVP, features and characters of ALVP;in the meantime, it has mad a deeper study on the function of ALVP and analyzed the historical information relating to this system to make the historical background of ALVP for complaints and current social state be corroborated for each other. In this way, it may study the reason of emergence and direction of development from the angle of history. It is followed by making an analysis to currently available information including four aspects, i.e. Jurisprudence, Constitution, Administrative Law, and Psychology and Sociology, expounding the historical background and social reason for emergence of ALVP. The author has, through consultation of corresponding literatures and analysis of social investigation results, further expounded the present condition of ALVP in our country and found out the social reason through analysis of the current social condition. In the meantime, the author understands, to some extent, the differences between the currently available relief means and the relief means of ALVP in our country and the other foreign systems similar to the ALVP as well, hoping, through comparison with these systems, to perfect the function of ALVP further and to make this system play its unique role in our country. Additionally, since this thesis is composed just during the interim between ALVP outdated and that active, the author compares ALVP outdated and thatactive and has explored the existing problems for the ALVP in our country. The problems can be stapled into two aspects, i.e. procedures problem and entity problem. To understand these problems and further to perfect the system should be major ideas of the thesis. The problems include unavailable behavior of ALVP of unified procedure standards, unspecific right and obligation of person of ALVP, some illegal procedures for ALVP and power problems of ALVP. After comprehensively analyzing and appraising these problems, the author puts forward the suggestions on establishment and reform of the system of LVP, considering that the reform of ALVP shall be started from the following five aspects: establishing highly efficient supervision system, specifying the procedure of LVP, introducing "listening and witnessing" of LVP, strengthening the formulation of ALVP and introducing the appraisal of third party. At the end of the thesis, the active statutes of ALVP is analyzed and in the author's opinion, the active statutes of ALVP's will sway the major idea of Manage Lawfully State Affairs of our country and accelerate the legality and rationalization of the country.
