Consideration On The Value Of Offender Risk In The Theory Of Crime

The cornerstone of crime includes the action of crime and the criminal. Criminal has distinctive peculiarity in offender risk .There are different opinions on the value of offender risk in the theory of crime .And the argument brings troubles in legislation , judicature and theory construction of Criminal Law .Based on the intervention of the criminal law , the author insists that the offender risk is an indispensable part of the crime system . This paper discusses the issue of offender risk in criminal law . In accordance with sociological survey and statistical researches , the author tries to prove the value of offender risk in the theory of crime . Then , the paper introduces the theory of offender risk and offender risk assessment system in the criminal procedural in China and some other countries . And most important of all , the paper introduces the offender risk assessment in the psychology of crime , and it`s contributions to criminal judicial system . Combining the above with the fact in China , we can establish a two-in-one mode of crime : action of crime and the criminal , serious disaster of action and offender risk of criminal .
