The Contrast Of Offender Risk And Personality Of Criminal

The paper discuss the difference and same points of offender risk and the personality of criminal ,include the history, definition ,the theory of evaluation and definition in the criminal of both, then we can found out that the advantage and disadvantage of offender risk and the personality of criminal. Fist, we would discuss the definition of offender risk, and how it grow up, we also discuss the theory of the personality, and contrast them, and we found that the definition of offender risk has some born defect ,and the definition of the personality of criminal had the feature of specific and diversity, and the personality of criminal also had some connection with the theory of criminal psychology in criminal integration. Second , we would contrast the theory of evaluation of offender risk and the personality of criminal ,then, we can found out that the theory of evaluation of offender risk is short of scientific and rational, while, the theory of evaluation of the personality of criminal is scientific and rational ; third, we would contrast the what the role of the both in the criminal . At last, we got the conclusion that we should discard the offender, and lead the definition of personality into the criminal.About the question of what the role of personality in the criminal ,I insist that in the stage of conviction we can approve of the function of out-conviction of personality in the criminal of theory ,but in the juridical practice, it is too soon to admit it; in the stage of measurement of penalty ,we should strengthen the role of personality of the criminal; and last we should use the definition of personality of the criminal to build the whole offender reform system.
