Study On The Thought Of The CPC's Exercising State Power According To Law

On the history of the CPC, "persisting in exercising state power according to law" was formally put forward on the 16th Party Congress. It was the essential great step on the problem of reforming and imposing the Party's style of leadership and governance. From analyzing the academic article's studies about exercising state power according to law since the 16th Party Congress, the writer think we should be the systematic thought of exercising state power according to law in order to supply a critical sample on the today's study.Having gone through the revolution, reconstruction and reform, the Party's style of governance must be "exercising state power according to law" instead of "exercising state power according to policy" because the Party have been "the two historic transitions". It is the inevitable conclusion of the CPC's thought of exercising state power according to law. Hence, firstly from the vertical line, the article studied the developing course which includes three phases: the new democratic revolution, from the founding of New China to the Third Plenary Session of its eleventh Central Committee and after the Third Plenary Session of its eleventh Central Committee. From theory source, internal strength, external thrust we analyzed the cause and studied the historical necessity from politics, economy, culture, governing condition, and so on. Secondly, the article studied the main thought of exercising state power according to law from the horizontal line. As the great creation of the governing style and idea, the CPC's exercising state power according to law should obey its principles and basic way of exercising state power according to the constitution ,entering into the state power office according to law, turning the Party's views into the law according to the legal program, ensurig the state power office fulfilling its legal function and performing its official duties according to law ,supporting the judicial organs to use itspower independently and impartially according to law ,which realize the Party's leadership over the state and society. At the same time, the Party must strengthen the guarantee of the Party's building and should make the new breakthroughs in enhancing the idea of exercising state power according to law, definiting the Party's governging of power and progam, improving the Party's governging leadship stystems, building institutions to run the Party so as to impove its art of exercising state power according to law. But we reasonably think, the Party's persisting in exercising state power according to law will face lots of difficult factors, which leads to be formidable. Then, we should get ready for them and conquer them by a spirit of reform and creation, which would exert its great effect to achieve the meaning of its political civilization and the value of era.
