The State Power Organs Supervise The Administration Organs Under The Leadership Of The Communist Party Of China

"The power has the trend of self-expansion and corruption.""Absolute power cause absolutely corruption."To supervise and restrict power is a fundamental principle of Modern democratic constitutional government. In order to guarantee the exercise of power with high efficiency and integrity, scholars have put forward the idea and opinion of restricting the exercise of power, such as"power constrain the power","the separation of powers","the power of social constraints"and so on. Supervision of China's National People's Congress at the national supervision system in our country has the highest status and the highest level, with the highest authority and the supreme law of the effectiveness. According to the characteristics of China's power structure, I believe that to achieve effective supervision of power and checks and balances, also to curb corruption ,we must improve the supervision system of the National People's Congressn under the leadership of the Communist Party. This paper summarizes the theory of the supervision of the National People's Congress in recent years , a number of new problems after the promulgation and implementation of"supervision law", also some specific supervision case in local people's congresses at all levels. The thesis is divided into four sections to describe how to improve the organ of state power supervise the state administrative under the leadership of the Communist Party. The first part introduce China's state power structure with Chinese characteristics and the existing supervision system in our country. In the second part, we analysis the current situation about the organ of state power supervising the state administrative, that is, the achievements and the main problems has been made in theory and practice. In the third part, we focus on the four resons about ineffective supervision. The first reason, theoretical problems exist on the principles of the National People's Congress system. The second reason, unreasonable factors exist on the political system of our country. The third one is the impact of negative factors of China's traditional political culture.The last one are the defects of authority on self-monitoring mechanism. According to reasons in the third part, this paper made some appropriate countermeasures to improve the supervision of organ of state power in the forth part. We must base on our supervision cases of the National People's Congress to explore new procedures for the supervision, monitoring methods and so on. This paper aims to coordinate the relationship between the supervision of the National People's Congress and the leadership of the Communist Party. This paper summarizes the theory of the supervision of the National People's Congress in recent years and some specific supervision case in local people's congresses at all levels. I hope this paper can have some useful ideas for National People's Congress supervision system in our country.
