Environmental Education, by the means of educating, can make human know and understand the environmental problems, at the same time, human may get thoughts, ideas, skills and behavior norms to father or to prevent new environmental problems from producing. Environmental Education is a very important aspect of national education. It is all-sided, mainly including environmental conscious education, environmental ethical and moral education, environment protecting technique's education, environmental policies, laws and conducts, etc. It is a request of reality human facing as the Earth resources are overly consumed; zoology is destroyed sharply; environment becomes worse and worse; relationship between the nature and human is much tenser than ever before. It is borne with the situation of human's resurvey his own social and economical action, profound reflection of the traditional development view, value view, and environment view and resource value. Presently, the world society at large considerd that changing the environmental moral conception is the foundation of human and nature, environment harmoniously and persistently developing. Environmental education is an effective approach to realize the world's persistent development. Each state or area is now making different forms of law for environmental education in order to ensure and push a good popularization of environmental education. Nowadays, Chinese academe is in the beginning of studying environmental education legislation. The relating legal norm is not perfect, which affects and limits our vigorous push and good popularization of environmental education. In fact, it restricts our ability to solve environment problems and the course of persistent development. Therefore, to systematically study the environmental education legislation has profound academic and realistic meanings. This article starts from the status quo. The first part makes an introduction of the concept of environmental education and its developing course; analyzes the internal relationship among environmental education, environment problems, and environmental education legislation; expounds the importance of environmental education for solving environment problem and the guaranteed function of environmental education legislation for implementing environmental education. The second part sets forth the necessity and feasibility of environmental education legislation. The necessity mostly involves three aspects: the needs to realize a persistent development, to improve the national diatheses and to practice citizen's environmental rights. The feasibility mostly involves legislation theory (including theories of persistent development and zoology ethnics), foundation of the state policy and the society conditions, etc. The third part introduces legislation practice of other countries and areas on the environmental education; summarizes their advanced experiences and the enlightenment for our legislation on environmental education. Especially, as the legislation on environmental education in the U.S is perfect, advanced, and representative, we are persuaded to use it for reference on our environmental education legislation. Thereby, this article does many writings for introducing American legislation on environmental education, and makes a general and intensive anatomy. The fourth part forwards the ideas of our legislation on environmental education. From conceiving the macroscopically outline to building the specific system, from choosing the mode of legislation to framing the basic synopsis, this part has made a dauntless and fancy plan for our legislation on environmental education. It adequately reasons why our legislation on environmental education has to choose the Legislature alone as lawmaking; it suggests our legislation on environmental education shall build a public commenting system on environmental education, a commenting system on professional environmental education, a fund supporting system for environmental education, an international cooperating system of environmental education, and a system of environment teaching staff and specialized organization's education, etc. These ideas are expected to provide some references for our legislation on environmental education.
