Study On Administrative Discretion

Administrative discretion is the core of administration power, Its overflowing has caused the change in the understanding of "rule of law" and the traditional principle about power-condition has been broken through. Administrative discretion has come to be an important form of administration power. The exercise of administrative discretion is one of the most difficult problems in the administration process in accordance with law, in order to realize the strategic target of administering the country with law, the strength of its control is needed. Because of all sorts of reasons, generally speaking, in our country, the research in this field lags behind researches on administrative law, which already directly influences the legal control of administrative discretion. Through analyzing the related subjects over world, this paper carries out researches focused on the concept of the administrative discretion, its existent basis of theory and reality, lays systematic emphasis on the accordance of the control over administrative discretion.
