| Circular economy, which is not only a new mode of economic development, but a brand-new theory of environmental protection, is the key of solving the predicament of resource shortage and environment deterioration, and implementing the sustainable development strategy as well. Thus, it is paid close attention to by the countries all over the world, especially those developed ones.It needs not only guidance, encourage and support from the government, but also legal guarantee to develop circular economy, strengthen environmental protection and set up the circulation society. Hence it is of far-reaching importance for perfecting environmental protection law and promoting sustainable development of society to analyze environmental legislation from the point of view of circular economy idea. Developed countries such as German, Japan and U.S have been very successful in this field. For the time being, circular economy idea is also reflected in China's environmental protection law to some extend. But it is not perfect and can't comply with the requirement of sustainable development strategy. On the one hand, there are many problems in legal system such as lacking of comprehensive legislation on circular society and specific ones on recycling of resources, and the imperfection of clearer production legislation. On the other hand, theory of sustainable development and idea of circular economy hasn't been fully implemented in environmental legislation, and the relevant legal principle and system need perfecting greatly.This paper makes some legislative proposals about the above-mentioned problems. First, we should perfect legal system, adopting the mode of basic - specific law between which there is comprehensive law on developing circular society.
