Discussions On The Standardization Of The Legal Language

The standardization of the legal is an urgent problem that must be resolved in the legislation and judicial practice of our country. This paper expatiates the significance of the standardization of the legal language. According to the current status of legislation, justice and law-enforcement of our country, the author's viewpoint is given, which based on analysis of the problems existed in the standardization of the legal language, including legislation language, judicial language, law-enforcement language, and law tongue.The author has come to the conclusion that, to resolve the problem existed in the legal language, we must embark from four aspects, i.e. language confliction, language logic, language structure, style of the type of writing; to resolve the problem existed in law-enforcement and legislation language, which shows in the form of confusable type of writing, dirty language and ambiguous language, we must ensure that the words employed accurately and sequently, rhetoric applied appropriately, and special attention should be paid on the use of neutral language in the law-enforcement and legislation language; the fundamental requirement of the standard law tongue is that the law tongue must accord with the criterion of law and language, to fit the double regulate of oral and write, and make the sentence fluently, link up smoothly, and avoid the discriminate-against language be taken.
