On The Standardization Of The Legislative Language

As legislative tool, legislative language carries legal information , and have its law as ordinary language. Researching legislative language is beneficial to legislative technology. Legislative language is a relatively independent language system, has its own rule, constitutes the core of Chinese legal language. The standardization of the legislative language is an urgent problem that must be solved in the legislation theory and practice of our country.This paper expatiates the connotation and extension, essential attributes and characteristics and the standards and significance of the standardization of the legislative language, starting from current status of the legislative language, based on Criminal Law and Criminal Procedure Law, it lists dis-standardization phenomena of legislative language, analyzes reasons, brings forwards measures of resolving questions and makes a certain depth of exploration and study. The paper holds that the dis-standardization of legislative language manifests specifically in words, syntax, illogical, defect in the use of punctuation and word order. Reasons for dis-standardization of legislative language are lack of academic organizations which are to be responsible for the drafting of laws, the lagged research of legislative technology, the vacancy of language review procedure, the weak awareness of language norms and the influence of Chinese language features and Chinese thinking mode. In order to avoid dis-standardization of legislative language, we should be of language standardization awareness, establish expert drafting system, improve the teaching and research efforts of legislative language, build a language review procedure and a legislative language database. The author expatiates language database and standardization of legislative language, commentary specifically from the four areas: model of legislative language database, the scope of selecting material of legislative language database, the principle of selecting material of legislative language database, using and search technology of legislative language database.Strengthening research on standardization of legislative language is useful to improve the quality of legislation, law enforcement and judicial activities, enhance the authority of law enforcement, lay a good foundation for high-level rule of law.
