This thesis covers the Foreign Related Employment of Chinese Seafarer and thelawful relationship between the concerned parties.There still exist some questions and confusions in the field of Foreign Related Employment of Chinese Seafarer even though the Chinese Seafarers have produced immense influence to and are taking more and more share in the international market of seafarer employment.In order to clarify some misty acquaintances and try to solve the problems in the practice of foreign related employment of Chinese Seafarer, this thesis carried out the study on the operational mode of the employment of Chinese Seafarer, on the relevant contracts under the different modes, on the right and obligation of each party and on the maritime claims relating to seafarer employment indemnified by maritime lien, from the beginning of basic concepts and questions in the practice of foreign related employment of Chinese Seafarer, pursuant to the theory and regulations of civil law, contract law, labors' law, maritime law and international private law, and referred to the research production of other scholars.Chapter 1 is on the basic parties of the foreign related employment of seafarer,such as ship's crew and seafarer, Ship Owners, Bareboat Charterers, Ship Managers,Ship Crewing Co. and Seafarer Employment Agency etc.. Chapter 2 is the discussion on the basic concepts and problems in employment and labor, on relevant laws and onseafarer employment market etc.. In chapter 3, the writer studied on the mode that theShipping Co., through a labors' contract only, employed the seafarer, on the legalrelationship between the parties and on the contents of the relevant labors' contract. In chapter 4, the writer studied on the mode that the seafarer was dispatched by the Ship Manning Co. through a ship manning agreement, on the legal relationship between the parties and on the contents of relevant contracts. In chapter 5, the writer studied the mode that the seafarer entered into employment contract with the foreign ShipManagers through Seafarer Employment Agency, on the relationship between the parties and on the contents of the relevant contracts. In chapter 6, the writer analyzed and studied the maritime claims relating to seafarer employment, the relationship between them and the relevant maritime lien. In chapter 7, the writer made the final conclusion.
