Studies On The Law Of Trade In Educational Services

It has been nearly 3 years since China became an official member of WTO. The influences of GATS on education service trade gradually show up. With the coexistence of opportunities and challenges, the advancement of Chinese education is to take place in the broad context of GATS. Therefore with GATS as its basic framework, combining Chinese education service trade with legislation practice, it is both theoretically and practically significant for the advancement of Chinese education and the prospering of education service trade that we do research on legal problems in the field of education service trade.It is only in recent years that Chinese scholars have done some research on the laws about education service trade and so far most of the research have centered around the interpretation of GATS and the discussion about whether the theories and practices of our current laws on education can be applied to education service trade. A convincing theoretical system for the development of our education service trade is still looming in the far distance and also the framework for the laws on education service trade is still to be constructed. Through the interpretation of education service trade in the context of GATS and the analysis on the current situation and future development of education service trade both domestic and overseas, this paper focuses on the theoretical foundation of our domestic education service trade laws, the reconstruction of the systematic framework for our domestic education service trade laws and the suggestions for our domestic education service trade legislation.
