| After the acceptance of WTO, China' agriculture faces drastic international competition. International competition in Agriculture is that of Sciences and Technology, as well as that of talents. In order to improve technological competition of China' agriculture, we must set down the protection strategy for intellectual property of agriculture. Different measures are taken to protect intellectual property of agriculture from different angles. The thesis studies how to protect intellectual property of agriculture legally.In a general sense , there are several contributions as follows :By analyzing the protection for Technological property of agriculture in China, the legislation of the protection for Technological property of agriculture in China and legal practice currently are evaluated and re-considered .Comparing the similarities and differences of other countries' protection for Technological property of agriculture , how to deal with the status quo at present is made certain. Absorbing and using for reference advanced experience of other countries, rational suggestions are brought forward for the sake of perfecting legal system of protection for intellectual property of agriculture in China.The first part , introducing the background and meaning of studying the thesis ,the actuality of research in our country and other countries and the methods of the thesis.The second one, the conception, the legal character and confinement of intellectual property of agriculture are concluded.The third one , introducing the status quo of legal protection for intellectual property of China' agriculture. Introducing legislative protection, the protection of legal practice, on the basis of them the protection for intellectual property of agriculture in our current law is evaluated and re-considered.The forth one , introducing the advanced practice of the protection for intellectual property of biology technology and foliage breed, the legal protection for the geography symbol. The use for reference is offered for the protection for intellectual property of China'Agriculture.The fifth one together with the status quo of the protection for intellectual property of China' agriculture ,and advanced experience in developed countries , suggestions are put forward for establishment of legal protection system for the future. |
