A Study On The Legal Problems About Managing The Aliens In China

This thesis consists of three parts:the foreword, the text and the conclusion. The foreword highlights the lag of the migration management system in China. It's necessary and urgent to absorb the theory of international migration law and reconstruct the migration management system.The text is divided into three parts:In Part I, explore the status and the problems about the management of the aliens in China. Discuss the separation of the two laws in exit and entry administration and the current situation of the migration management system. In Part II, research into the status and trends of the international migration law and the international migration management systems. Introduce the international migration theory to China to improve the management of the aliens. The Part III is the core of the thesis, discussing the reconstruction of the migration management system as well as changing the current entry and exit administration to the comprehensive dynamic migration management. And finally the author discusses how to improve the management of the aliens in practice.In the conclusion, in the view of the reform, the author highlights the three cores of the new management system:entry and exit administration; dynamic management of the daily; and the border and national security management.The innovations of the thesis include:To change the exit and entry administration to a comprehensive dynamic management of the aliens in China; to establish a comprehensive information system and emphasize the coordination between the departments; to propose implementation of the Residence Permit IC Card to carry out the residential registration system and enhance the dynamic management. The author also makes a number of legislative proposals, such as giving the basic-level policemen the power of interrogating the foreigners and more punishments on the "Three illegal acts", etc.
