On The Improvement Of The System On Preventing The Entry Of Aliens

The system of preventing the entry of aliens is the most important one of norms related with state sovereignty, security , interest and national economic and social development environment, which is still of vital significance for us to fulfill our obligations under international laws, to establish a good international image and to build socialist harmonious society. But, with the influence of historical and realistic reasons, the system is far from perfect and still has weak points. This norm has lagged behind the development of economy and society as well as the current situation on exit and entry, which still needs to be revised and improved.First, in chapter one, this thesis makes a brief introduction on the basic problems on the system for no admitting of the entry of aliens based on the international migration theories and national laws and regulations. The object of the system refers to alien people who is exempt nationalities and can not enjoy the diplomatic privileges and immunities. Through the explanation on the notions of entry, right to enter and frontier inspection, this thesis puts forward the nature of the policy and gives a detailed description on the system by legal backings and practice demands, which laid the groundwork for chapter two and three.Chapter two firstly introduces the actualities and difficulties of the system, then deeply analyses the differently developments on migration policies in China and foreign countries in order to find the solutions to the present situations. Besides, this paper also sorts out the legal system to improve the framework of foreign entry system, which including the system of rules, procedures and contents.Chapter three generates the suggestions on perfection of the entry system. To solve this problem, the following measures are to be taken: quickening the step of legislation on exit and entry management, enhancing the solemnity and unity of the system, and gradually establishing a scientific management system and confirming the relationships between power and responsibility. Finally, in order to establish a scientific and prefect system on preventing the entry of aliens, the author puts forward his opinions and suggestions on the legal applications and the legal guarantees.
