On The Purpose Of Administrative Procedure

Study of the theory cannot leave the examination of social practice, the development must rely on the support of the theory. The administrative litigation purpose is the leader of theoretical construction of the Administrative Litigation System, which must be play an irreplaceable role in specific constructing the Administrative Litigation System and promoting the whole development of the science of administrative proceeding law. Although law circles of our country has been pay more research on the purpose of administrative litigation, few people pay more attention to the law from the pure legal philosophy respect to comment on it. The article intended to analysis on the purpose of law and litigation from the aspect of the law theory. Finally, under the guidance of the administrative litigation purpose to rational constructs administrative litigation system in our country.The paper will deep study on the concept of purpose from the view of philosophy, on the purpose of law and purpose of litigation from the view of legal philosophy,in order to provide the theoretical basis for reposition of the administrative litigation purpose in our country. On the basis of exploring several elements which influence the administrative litigation purpose of our country, with lots of the administrative litigation purpose theory, to provide the better area for the administrative litigation purpose of our country. Thus, propose the rational position for the administrative litigation purpose of our country.
