The Research On The Protection Of The Right Of Labor Security And Health

The right of labor security and health protection is the main content of labor legislation which initially puts its emphasis on the protection of child and women labor, including the limitation of maximum working hours as well and it develops into providing the double protection for the labors'physiology and psychology nowadays. Especially the conception of "decent work" which proposed in International Labor Conference in 1999 indicates the task and direction of development of the right of labor security and health protection in the future. However, the protection of the right of labor security and health still falls behind, so it is necessary for the author to discuss the protection of the right of labor security and health in order to guide for the work of protection.This thesis bases on the analysis of current situation of the right of labor security and health at home and abroad to analyze the results and tendency of the right of labor security and health. The author also points out the problems and shortcomings of the right of labor security and health and we also provide a series of corrective actions. For example, we can announce a comprehensive law of labor security and health which puts the labors'right to dignity and mental health into the labors'right system and we can also establish the organization of the right of labor security and health. The government can supervise company to establish Credit Management System which has some similarity as bank reference management system to urge the company carry out the social responsibility. In judicially we can introduce the public interest actions mechanism and give the right of action to individual and so on. Through these ways, we can achieve the double protection for the labors' physiology and psychology and finally carried out the "decent work"...
