"Labor Contract Law" in the labor law system plays an important role, it makes up for gaps in the labor law, improve the labor contract's legal system. "Labor Contract Law," the legislative purpose is to regulate employers and workers enter into the behavior and performance of labor contracts, protect the lawful rights and interests of workers and promote harmonious and stable labor relations."Labor Contract Law" implemented to date more than three years almost, and its implementation results? This paper based on the full investigation and study of the "Labor Contract Law" small and medium private enterprises in the central region the status of implementation. The main text consists of three parts:The first part is the content and conclusions of the investigation report, focusing on investigating the status of the signing of labor contracts and employment status of the existing law. Since the"Labor Contract Law" since the implementation of labor contract rate increased significantly, but the overall level is still low, and there is imbalance in the distribution; short-term labor contracts tended to be more evident in the second part from the general staff especially; the contents of the labor contract is not enough specifications. In addition, the phenomenon of illegal employment is still a lot there, mainly in the payment of wages, arbitrary extension of working hours, social insurance contributions is not comprehensive, a disguised fee deposit to the employee, business rules development process is undemocratic and so on.The second part of workers, enterprises, trade unions, the labor administrative department, the legal point of view of their five reasons for producing the above-mentioned conditions.The third part of the above reasons put forward relevant measures. Mainly in the enterprise, the popularization of legal knowledge, to improve the legal literacy of workers, changing the business philosophy, to enhance trade union role in coordinating labor relations, to strengthen supervision and law enforcement work and labor, "Labor Contract Law," the perfection of the relevant provisions of its own.
