Legal Regulation Of Network Marriage

In recent years, the divorce case caused by the alienation of mutual affection due to network marriage is on the rise year by year. More and more public attention is paid to the disputes between network marriage and traditional marriage, network family and real family; however, no law or regulation has been issued in China to explicitly regulate network marriage. Therefore, law application blank emerges in dealing with law suits caused by network marriage. This paper attempts to conduct related theoretical analysis on this practical issue, and explores on the countermeasure to resolve this dilemma. It consists of such parts as follows:Part 1 mainly poses the issue. By means of citing two real cases related to network marriage, this part introduces the issue "network marriage" game brings to people's daily life. Furthermore, it makes a brief introduction to the purpose and significance of the research, study method and its originality.Part 2 mainly focuses on defining such new phenomenon-network marriage by analyzing the conceptual characteristics of network marriage, the nature of its causes and the distinction between it and the traditional marriage. Part 3 mainly puts forward and analyzes the problems based on the previous introduction. It analyzes the impact to social foundation of the marriage and family law by network marriage through extending beyond existing law, and comes to conclusion that the national current marriage and family law lacks constraining forces on regulating network marriage which is posing threats to the existing marriage and family law. Part 4 mainly explores the solutions to this problem in accordance with the above analysis.
