| This article contain three part: Introduction, body, conclusion. Introduction: Briefly illustrate the essence of bribe, present situation and the insufficiencies which exist in definition of bribe of our law.The body is divided into three parts:Part one,the issue that whether sexual bribe could be definited as crime. By explanation of three viewpoints in penal law arena about definition of law and enumerate of some relevant legal provisions in abroad and Hong Kong/Marco area, to analyze the possibility and actuality that definite sexual bribe as crime and finally the conclusion is no.Part two, the definition of bribe crime amount. In part one by research on the definite standard of bribe amount, the writer has the opinion that bribe crime should not be definited via the specific amount but via abstract definition of economic development level in relevant area. In part two via the think to the social perniciousness and subjective galloping of bribe crime and corruption, the conclusion is that bribe crime is not equal to the amount of bribe. In part three I will rise my own opinion on via the definition of 3 new bribe crime amount.Part three, in regard of the division of bribe crime and bribe via social effect. First, analyze the deficiency of two crimes via illustrate the effect which bribe crime by social effect to the exist of bribe crime system. Second find the common of these two crimes via comparing the characteristics of constitution. The two crimes have the differences while they are in common in the mean time, which result in the complication while commit the two crimes aforementioned in the same time. Each factors and situation should be considered before get the synthetic judgment.Conclusion: Raise the opinion that we should crack down the bribe crime hard and deeply research on the theory basis in the mean time. Settle the new come situations, new problems via perfect the law continuous and make our afford for the construction of a clean and honest administration.
