To Explore Sexual Bribery Crime

Since1980’s the scholars gave rise to the sex bribe, cases concerning sex bribe arebecoming spread rapidly. Sex bribe, infringing directly the honesty of public servicepersonnel, is typical of property interests of the bribery.Compared with non-propertyinterests of the bribery like property interests of the bribery, sex bribe has greaterharmfulness to public society. But it hasn’t been put under the regulation of criminal lawand relevance laws, which make it become a blind angle. Whether to convict sex bribe as acriminal crime has aroused the attention of the whole society. On the basis of researches,this paper tells that sex bribe should be included in criminal law and be punished strictly.This paper has following four parts:The first part outlines the sex bribe, including its definition, characters and expressionforms.The second part discusses the current situation of legislation. For one hand, the paperanalyses the crash of the sex bribe in the theory. For another hand, the paper tells thelegislation expression abroad and in Chinese ancient times.The third part presents the legitimacy of the criminalized sex bribe. It holds that thesex bribe should be criminalized, and offers the analyses from two points. Firstly, thepaper analyses the feasibility from the following aspects. Firstly, the paper analyses thefeasibility from the following aspects, Secondly, from sex bribery crime the feasibility ofthe Angle analysis.The fourth part tells the ideas of the legislation of the sex bribe. The author presentsher views of bribery arrangement in the provisions, the cognizance and the sentencing ofthe problem of bribery.
