On The Modernization Of China's Legal System

Modernization of the legal system of socialist in China is an important part of the modernization system. With China's continuous development of modern market economy, and the tremendous impact of the trend of globalization, we must re-examine the process of our modernization of the legal system. Therefore, the author intends to use the urbanization into perspective to analyze the process of modernization of China's legal system.The first part explains the meaning of modernization, urbanization and modernization of the legal system, analyzes the internal logic of this relationship between them. It is found that, in essence, human's way of life evolved from traditional to modern is the core of modernization. Urbanization is the result of the development of modern productive forces, its commitment to rural society from the traditional form of urban and rural areas to the integration of a new social form of transformation, integration of urban and rural areas, is the way of life of people changing from traditional to modern important form. The modernization of the legal system is an important part of modernization, it is a worldwide transformation of legal system from the traditional to the modern form, and from traditional rule of man to the modern rule of law in social transformation of social change process. In the process of urbanization, the emerging new urban way of life which has the concentration, mobility, specialization and heterogeneity characteristics, plays an important part to the modernization of legal system, it effectively promotes the process of modernization of the legal system. The second part examines the process of Western urbanization and modernization of the legal system, analyzes the important influence of urbanization on the modernization of the legal system, and indicates that the urbanization is the significant driving force to the modernization of the legal system. Firstly, examines the city law's important impact on the modernization of Western legal system. Secondly, examines the effects of urbanization, indicates that it conceived, produced a civil society. Finally, discusses the Marxist theory on the interpretation of civil society, and indicates that the civil society is the community foundation of modern Western Modern rule of law.The third part of this article examines the development process of urbanization and modernization of China's legal system, points out that the phenomenon of superficiality in the construction of modern legal system attributed to the lack of local civil society in this process. And indicates that the theory of civil society is important impact on the analysis of China, the Max's achievement of the theory of civil society is both western and all mankind, its global significance means that it has an important value and reference guide for China's construction of local civil society. The results of Marx's theory of civil society is both the West and all mankind, with global significance, the construction of local civil society in China has an import- ant value and reference guide; and the current construction of China's civil society has a real possibility. Therefore, we must combine our reality, construct Chinese local civil society, and this is the foundation of our modern rule of law.
