Law Study On Housing Quality Guarantee

Housing is the most basic material conditions of human survival and development.housing quality good or fall have a direct relation with people's quality of life.However, at present, our country have many unqualified resident.the reason why so many unqualified housing are the flaw of social and institutional system, the mainly reason is the institutional. So rethink problems of housing quality assurance mechanism, establish and perfect housing quality guarantee mechanism that letting people have a safe and comfortable dwelling is significant and profound.This paper mainly divided into five parts to state housing quality assurance system:The first section illustrate the basic theory of residential quality guarantee.First,explain the concept of "housing" and state the housing character which different from other architectural engineering characteristics.and then through the difference of housing quality from other architectural quality and products quality to state the specially of housing quality.The second part of this paper introduces the quality guarantee system model in residence of the historical evolution and the supervision system in other countries.Through the methods of analysis and comparison this section bring forward the mode our country should choose at present.The third part is a central part of this paper. This part makes a thorough analysis of the current housing quality guarantee system, points out the concrete structure and legal effect. Residential quality guarantee first needs legal safeguard, and legal protection requires specific legal system to safeguard Laws designed to be reasonable to improve the quality of hosing. Therefore, this section detailed listed the quality guarantee system and each one's character,include market access system, engineering supervision system, residential quality guarantee system and project completion acceptance system, through analyze these various systems which play different roles in the housing quality guarantee to find out the real cause of quality problems in our country.The fourth part is also the core part of this paper. This section detailed analysis the subject and rights and obligations of residential quality guarantee system.at present, China's residential quality guarantee subject mainly divides into the government body and market body. The government subject in residential quality assurance plays a macro guidance function, which mainly make corresponding laws and regulations, through the legal means to indirect supervise the market body quality behavior. Market subjects are mainly including project owner, reconnaissance design, construction units and supervision unit. Each market body do business must be within the limits prescribed by law and accept the supervision of law and regulations.not only should they respect laws and regulations related but also project contact, technical criterions and technical standards.The fifth part state the lack of our current residential quality guarantee system and also discussed the improvement measures.The institutional defects caused residential quality cannot up to state standard, so except perfecting existing system,other countries system which are advanced and suitable for China's national conditions after modified should be introduced.
