Research On Documentation-Submission Obligation In Civil Procedure Law

Evidence is the basis of clarifying the fact and entering right verdict for a judge. The evidence system plays an important role in the law of civil procedure, especially the evidence collection system. The loss of evidence collection system in our country makes parties face many difficulties in proving the fact in the case involved. By researching on the evidence collection system in other countries, we found out that documentations-submission obligation provides an important means to collect the evidence. This article introduces the documentations-submission in other countries and analysis the possibility of setting the documentations-submission obligation in our country in hoping of improving the evidence collection system in civil procedure law.This article discusses the theme in five chapters as following:In chapter one, the basic conception and nature of the documentations-submission obligation is introduced.In chapter two, writer clarifies the scopes of the documentations-submission obligation, including ordinary obligation and special obligation.In chapter three, writer introduces the process of applying for the order of documentations-submission, and the requirements checked by the courts.In chapter four, writer introduces the sanction measures when the obligators refuse providing the documentations.In chapter five, according to the legal environment in our country, writer puts forward the idea of setting the documentations-submission obligation in our country.
