| The setting of civil executing institution determines the civil enforcement system, civil executing institution's nature and status affects the executing system reformation, also affects the exploration of new executive methods. Our country's civil executing institution have experienced some radical reformation, difficulty on the civil execution has been reduced in a certain extent. But now, China's civil executing institution still has a lot of problems; scholars also have different opinions on how to perfect the executing institution. This paper concentrates on the reformation of our country's execution institution; the whole article can be divided into four chapter as follows:The first chapter is about the basic concept of execution institution. In this section, the author introduces the history and current situation of the civil executing institution reformation. At present, the civil execution institution still has some shortcomings. The second chapter is comparison on establishment of execution institution and thought at foreign countries and states. At this part the author want to summaries some enlightenment for our country's reformation. The third chapter is about the basic theory of execution institution. The author defines the civil enforcement power, analyzes its character and nature. The civil enforcement power can be divided into two parts, faculty jurisdictions of execution and faculty implementation of execution. This chapter also defines the execution institution, and talks about its function. The fourth part is the main part of the paper, is about the author's opinion on reformation of civil executing institution. In this section, the author considers various factors effecting on our country's civil executing institution reformation, offer some proposals from the macro and micro aspects. This section discusses these problems below: the distribution of enforcement power, the settings and duty of executing institution, the executing officer's duties and so on. |
