On Traffic Offence Of Joint Negligence

Offence of joint negligence objectively exists,we can't disconsider its value because of the current legistation and traditional law theory,and it's especially important in traffic offence. This article is divided into four parts. The first part discusses views of offence of joint negligence in and out of China and the choice of legislators in China。The second part discusses possible offence of joint negligence in traffic offences,and casualties and elements of offence traffic casualty of joint negligence.The third part discusses whether offence of joint negligence should be treated as joint offence in two aspects,one of which is juristal theory,and the other is prove that treating offence of joint negligence as joint offence can suit penalty to crime and criminal responsibility better by means of analyzing treating of instigating and forcing breaking traffic rules in traffic offences.The fourth part discusses whether conniving of breaking traffic rules constitutes offense traffic casualty of joint negligence,and the diffences in determine the commission of a crime,differentiating responsibility,and measurement of penalty between conniving of breaking traffic rules and instigating and forcing breaking traffic rules.
