The real estate market information asymmetry has led to irregularities in the market, the market a serious waste of resources, consumer interests are damaged, triggering adverse selection and moral hazard, among others.With the deepening of the urbanization process.China's "Property Law" was first established in the notice of real estate registration system. As one of important system of real estate, the registration of caution is made up of the German civil law in the middle age. The nature of regulation is to make property rights replace creditor rights for balancing the interests of the persons related in the changing of the real estate. Advanced notice registration is one of the important system of property rights in the German and Japanese civil law. The nature of regulation is to make property rights replace creditor rights, balancing the interests of the persons related in the changing of the immovable property. This article probes into reality meaning of the creation of advanced notice registration in our country, and the legislation illustration from foreign country, and gives the author's view on how to create the system of advance .This paper through a combination of foreign and regional advance notice registration system, the nature, scope and effectiveness of the basic Comparison Study of Theory, focusing on analysis of the real estate property preliminary registration system of the nature, scope and effectiveness, on our "Property Law" provisions of the content of advance notice registration system discussed .
