The Analysis And Discussion Of Related Issues Of Escaping After Traffic Accident

With the quick development of economy in our country,the vehicles such as automobile are more and more,but increasing transportation accidents attract social attention and become a severe social problem.What's more,some of the troublemakers escape after the accident in order to be free from the law responsibility,resulting in some victims'death because of no immediate aid.In order to protect the victims and punish the troublemakes effectively,the new Criminal Law made rules on the issue of escape-causeing death.Additionally,the Judicial Interpretations of the criminal law by the Supreme People's court in 2000 also explain this.However,there are still many controversies during the judicial practice.This paper ,through the analysis and discussion of one case of traffic accident, analyse and reseach three aspect which include escaping after traffic accident . the definition and confirmment of escaping after traffic accident which lead to death and how to escape after traffic accident which lead to death and the delimitation of escape-causing death which belong to the purposely killing people crime has gotten a deeper understanding on the issue of escape-causing death,expecting to be helpful to the judicial practice.The paper consists of three parts:The first part,makes a deep research on the definition and confirmment of escaping after traffic accident.The second part,makes a detailed analysis on the definition and confirmment of escape-causing death.The third part, makes a deep research on the delimitation of escape-causing death which belong to the purposely killing people crime.
