The Research Of Personal Damage And Legal Relief Problem In The Primary And Middle School

In Chinese educational and legal circles, there is now unprecedented concern for the problem of personal damage and legal relief in the primary and middle school in recent years. Because of a short history and innate drawbacks of personal damage and legal relief mechanism, there are a variety of opinions. To begin with, this paper defines the concept of personal damage and legal relief and interprets the legal relationship between schools, teachers and parents. Second, by analyzing and dealing with principles and range of personal damage, the article explores the relatively reasonable measures of personal damage and legal relief in the primary and middle school.There are five parts in the paper. They are as follows.I. Introducdtion. To introduce the significance, train of thought and methods by documents.II. To elaborate the basic theory. To analyse the legal relationship between schools, teachers and parents and deal with principles and range of personal damage, which is based on the foundation of theory about the problem of personal damage and legal relief in the primary and middle school.III. To describe three ways of personal damage and legal relief in the primary and middle school.IV. By comparing the related study of legal relief abroad and considering the actual situation in our country, to give some suggestion on my own.V. To explain measures of personal damage and legal relief in the primary and middle school . In this paper, I analyse the problem existing in personal damage and legal relief in the primary and middle school and conclude four measures, that is, to form the value of personal damage and legal relief in the primary and middle school ; to perfect personal incident damage and relief system ; to analyse the cost of legal relief and to discuss the concrete practical operations.
