Legal Relations Between Schools And Students

Legal relations between schools and students are those of rights andobligations, which formed when the laws adjust the behaviors of schools and students. There are two major theories concerning the legal relations between schools and students. One is that of relation of special power, the other of contracts. I think the legal relations between schools and students are binary. One is administrative legal relation, the other is civil legal relation. The features of them are different, and so do their contents.In today's China, students' rights are sometimes neglected and even offended. Therefore, In the last two parts of the thesis, I discuss the schools' infringing act on the students by analyzing cases, which exists in the field of education. And then I put forward some suggestions for improving the unequal status between schools and students and ensuring the full realization of the students' rights.
