Legal disputes occur frequently between vocational schools and their students. Courts at all levels have handled some students sued the school's case, which is very complicated. This paper attempts to analyze the legal nature and its status of China's vocational schools to explain their legal relationships. The author thinks that for the students, schools have a double identity of the principal, as the main civil and within a certain range of the principal administrative capacity. The legal relationship of vocational schools and students should be defined as a combination of administrative law and civil law. On one hand, the disciplinary action, the decision to drop-out students graduate certificate and the employment report card of vocational schools all have the effects of the act, and they should take administrative reconsideration, administrative proceedings channels for relief. On the other hand, the relationships between schools and students should be civil legal, which should be taken through civil litigation. On this basis we should draw on the experience of Western countries and remodel vocational school students' behavior management principles and the management and supervision and relief system for vocational school students...
