On Reconstructing The Law System Again For The Animal Protection In Our Country

The purpose of this thesis is to completely ameliorate the law system for the animal protection in our country and to realize the collective survive and development between the human beings and the animal. The current law system for the animal protection in our country is very imperfect and exists many problems, which make our work of the animal protection not effectively carried out. In order to find the reason of falling into the morass of the law for the animal protection, in this thesis the author deeply studied and analyzed the current law. Found that the direct reason of leading to this result is the legislation guiding ideology eagering for quick success and instant benefit and built on the base of the mechanism world view. The basic reason of which is short of theory base. Moreover figured out that the law for animal protection must be built on the base of correctly understanding the objective world. That is, it must take the scientific theory for the base. The legislation that has no theory base is shallow one. It isn't able to undergo the test of practice. When searching the theory base for the legislation for animal protection, the author found the animal ethics and studied and criticized the popular animal ethics view in the western. The author expounded and proved that Rolston's view about animal ethics is built on the base of correctly understanding the objective world. It is according with the rule of the nature development and should become the base of the animal protection legislation. On the base the author put forward a series of amending suggestions for the system of animal protection in our country and finally reformed the law system whose content is harmonious and centralized and whose structure is integrated.
