| The female crime of Qin-Han Dynasty refers to an action that endangers the society and the feudalism as the main object of the implementation and therefore they subjected to corresponding penalties. Generally speaking, family is the main living space of women of Qin-Han Dynasty. So the study of crime often limited to the family. People usually lack of the sense that regard women as the main object in criminal matters. We are lacking of the material about crime analysis in this period. In addition, previous studies paid more attention to the name of crime and the sentence, less concerned about regulations of government in Qin-Han dynasty, such as the instruments of torture, prison, labor, redemption. This paper attempts to explore these issues in order to do some useful complement.First of all, this paper examines all types of crime and punishment of women in Qin–Han Dynasty, that is, according to the scope of the crime, I divide female criminality to two kinds, namely the civil and court female criminality. Ordinary crime of female crime is the same with the male crime in Qin-Han dynasty, there are two regions about this type of crime-civil crime and court crime. Regard as civil female crime, there were several types of crime: flee, stolen and hide crime, killing the children, assault and others, fierce and lacking of filial piety. The crime of evil words appeared in Qin Dynasty. In Han Dynasty, the types of female crime were murder, false accusations, fraud, bribery, rebellion, evil words, and witch poison and so on. The court female crime especially refers to royal members. The types of crime were witch poison, misconduct, disorder, murder, conspiracy and lacking of filial piety, micro-off and so on. Particular crime only refers to the female crime, including elopement and rape.This paper discusses the main causes of female crime based on various crimes. In addition to personal reasons, the most of the crime is due to medical conditions, the reality of survive, social concept, social atmosphere and other social factors. The obvious features of crime are: types are varied, the space is vast, and the modus is independent. These characteristics reflect women participation in society, the tendency to detach to their family.Finally, the paper discusses related management to female prisoners of Qin-Han dynasty. At that time, some names of crime have already devoted to female crime. But there are no obvious gender characteristics in the aspects of the instruments of torture and the prison. Once the women crime, they were forced to wear prison uniform and instruments of torture. If court women crime, they would be sent to Yongxiang, Yeting prison or Baoshi prison. In addition, the rulers of Qin-Han formulated special regulations to punish female prisoners. At the same time, the government of Qin-Han also developed a series of regulations to compassionate female prisoners, such as allowing them to reduce or avoid from the penalty by redemption. However, owing to many restrictions and harsh condition, the life of these female criminal is still arduous. |
