Intangible Cultural Heritage of a country or a region show the soul of their national character. It shows a particular nation's creativity and civilization, reflecting their cultural identity and the sense of history. For a country, a nation and even the existence of mankind, their Intangible Cultural Heritage has immeasurable significance.With the development of modern industrial society, uncountable Intangible Cultural Heritage to varying degrees suffered threat and destruction. Some even perished beyond retrieve. Result in the UNESCO's unremitting efforts, the safeguarding of Intangible Cultural Heritage has become an international legal legal obligation of every country.In view of the characteristics of administrative power, it is unavoidable for the government to have a voice in the safeguarding of Intangible Cultural Heritage. Furthermore, it may even dominate the action. The real issue is how to ensure the validity and rationality of the efficient and powerful administrative action.In this article, Kunqu Opera which was China's first appeared in the "Human Oral and Intangible Cultural Heritage" list, was taken as a typical case to analyse problems we encountered in the process of the safeguarding of Intangible Cultural Heritage. The article specifically focused on how to regulate administrative action. Then on a more universal level, the article discussed the necessity of the administrative action in the safeguarding of Intangible Cultural Heritage.The corresponding values and theoretical principles were elaborated as well.Finally, the article made a attempt to design a legal system to regulate the administrative action in the safeguarding of Intangible Cultural Heritage.
