| At present, with the development of economy and transformation of the society, the problem of the social vulnerable groups( SVG)becomes evident and significantly affects the stability and development of the society. Thus, we should pay more attention to the protection for the rights of SVG. But the present studies are mainly focused on the sociological field, and there is no deep analysis in legal perspective to solve this problem. Therefore, it possesses very important theoretical and realistic significance to study the legal protection of SVG. The combined methods including comparative, historical, demonstration and inductive analyses are used to study this problem in the paper. The paper consists of four parts. In the first part, the conception of SVG is given according to the combination analysis on sociological and legal perspective. It points out the features, division and essentiality of right protection of SVG. The reasons of SVG formed are analyzed. In the second part, by analyzing the legislation, execution of law and the judicature, the possible problems in the protection of SVG are investigated. In the third part, on the basis of the comparative analysis on the legal protection of America, German and Sweden, we consider that the successful experience in these countries is social welfare polycentrism, social run oneness, executive rigorism and jurisdiction authoritism. Meanwhile, we points out that the SVG should be properly protected in the principle of either survive or competition. In the fourth part, the ways to better improve the legal protection on Chinese SVG are put forward based on the legislation, execution of law, judicature and etc.. It points out that, in order to realize the protection of SVG and the harmonious society, the right consciousness of SVG should be enhanced to make them have the mature right conception. This is the innovation of the paper, and we hope it is favorable to solve the problem of right protection of SVG. |
