| The reformation of the law in the late Ching government and bourgeois lawmaking during the Nanking's Temporal Government made up the early stage of the Chinese law modernization. As an important participant,founder in the early stage of law modernization and steadfast defender for democracy and republic in the North Warloads, Wu Tingfang's law thought and practice plays a certain role in the process of the Chinese law modernization.Wu Tingfang's law thought and practice takes on obviously evolutionary orbit from bourgeois reformism to bourgeois democracy and republic. By making a deep—going analysis of its causes. Process,features,experience and lessons of Wu Tingfang's law thought and practice from the angle of modernization, We can not only fully understand the complexity of"New Policy"in the late Ching Dynasty and the Revolution of 1911 but also make deep researches on law and law thought of Chinese modern history and provide some useful enlightenment for today's lawmaking.The main body of this thesis consists of three parts. In part one, the author makes a detailed analysis of Wu Tingfang's concrete law practice in the late Ching Dynasty and generalizes his bourgeois law reformism. The stage when he participated in mainly lasted from the year 1903 to the year 1907.In part two, the author mainly makes a tentative analysis of his democratic and republic law thought which lasted from the year 1911 to the year 1922 When he threw himself into bourgeois democracy and republic until he died for them.In part three, the author deeply analyzes the reasons why Wu Tingfang can change his law thought and practice from constitutional monarchy to democratic republic. At the same time, the author evaluates objectively and historically the historical position and limitations of Wu Tingfang's thought and practice in order to provide some usefulreferences for today's lawmaking.In the end of this thesis, the author generally evaluates Wu Tingfang's law thought and practice and subtly brings the historical and practical significance of the research to light. |
