On The Consumer Dispute Settlement Mechanism Of The Improved Non-litigation

The protection of consumer rights has been a very important social and strategicproblem for a long time. Nowadays as the consumer dispute has been on the increase, the nonlitigationprocedure to the consumer disputes can lessen the pressure of lawsuit solution ,as it isflexible, convenient and effective and so on. Although the legislation on consumer rights hasbeen emphasized in our country, and the consumer rights protection legal system has beenformed , as these laws stipulate substantiality, the non-litigation procedure can not meet thepractical needs of the consumer disputes ,this is because the procedure lacks enforcementbetween settlement and mediation agreement, the consumer association groups have limitedrights, the lack of the specialized administrative consumer rights protection group and thesimple related stipulation .all these have contributed to the great amount of unsolvedcomsumer disputes.So it is necessry to construct the comprehensive non-litigation procedure tosolve the consumer disputes. Beginning with the summary of theory in the non-litigationprocedure to consumer disputes, this thesis analyzes its function by employing the theories ofJurisprudence of Economic Analysis,it points out the current situation and defect of the nonlitigationprocedure in our country, and makes an explaination of the related systems in somerepresentative countries. On the basis of this, it proposes the ideas and visions to improve thenon-litigation procedure in our country from the national conditions of China .
