Health is very important for mankind. It is one of the basic conditions for survival, and essential to maintain a normal life. Every human being is entitled to the enjoyment of the highest attainable standard of health conducive to living a life in dignity. The human right to health is recognized in numerous international instruments. The right to health must be understood as a right to the enjoyment of a variety of facilities, goods, services and conditions necessary for the realization of the highest attainable standard of health. The right to health includes not only to timely and appropriate health care but also to the underlying determinants of health, such as access to safe and potable water and adequate supply of safe food. States are under the obligation to respect the right to health, to protect the right to heath and to fulfill the right to health. The measures to implement the right to health will vary significantly from one State to another. But it is necessary for each State to take whatever steps to ensure that everyone has access to health facilities.Farmers who are the vast population in our country, and their right to health are in a disadvantage for a long time. As a large agricultural country, it is necessary for us to protect the health of farmers. It is an important aspect of a harmonious society. How to improve the right to health guarantee of the farmers is the article to be explored.There are five parts in this article. Chapter 1 is the basic theory of health and guarantee of the right to health. Firstly, health includes physical health and mental health. Secondly, the right to health is ' the right to the highest attainable standard of health'. Then, we talk about the properties and characteristics of the right to health and the historical evolution of the right to health. The guarantee of the right to health can be divided into two parts: the international guarantee and the domestic guarantee. International guarantee is divided into judicial and non-judicial means. Domestic guarantee of the country mainly emphasize that State should respect, protect and fulfill the obligations. Though the realization of the right to health is progressive, the nation should try its best to improve farmers' health. Chapter 2 introduces separately guarantees of the right to health of farmers in developed countries and developing countries. About developed countries, the paper inquires into the situation of America, Germany and England. As for the developing countries, the author selects India, Thailand and Brazil to study. From them we can learn that it is indispensable to attach importance to the universality and fairness of farmers' guarantee of right to health. The health status of farmers improved gradually. During the course, government played an important role.Chapter 3 talks over the historical and present situation, and problems in safeguarding the Chinese farmers' right to health. Lack of government investment and health equity are the main problems of our country. At the same time, their living environment and public health are not so good as well as the basic medical insurance.Chapter 4 is how to improve the right to health of Chinese farmers. There are four principles we should comply with—the principle of fairness, the principle of government-oriented, the principle of tilt guarantee and the principle of universality. After that we talk about the guarantee of law and policy. The right to health should be written into the constitution .It is necessary to make laws to improve the right to heath of farmers. We carry out the party's and the country's relevant policies. At last, set forth concrete measures to safeguard the right to health of Chinese farmers. We must improve public health and peasants living environment. It is important and necessary to perfect rural medical and health service system. We must perfect medical security system for farmers.The last part is the concluding remarks. Only country fulfills the corresponding obligations, can farmers realize the guarantee of the right to health.
