| Nowadays,vice drug clinical test is to be seen repeatedly.Among the published clinical research papers abroad,there about 12% of the research aren't consistent with ethical requests,many people still can't distinct the ethical drug clinical test from"test on people"on ethical cognitions.At the stage of drug clinical test,although the bases of test operations have made some regulations to protect the testees'benefits,for most of the testees(include patients and healthy people),which are unfamilar with professional iatrotechnique,drug clinical test is a very strange field,so they always occupy a inferior position when participating in the tests,they could only obey passively instead of making their own choice independently .This insulted in many testees'legal benefits can't be safeguarded. To strengthen the safeguards of the testees'legal benefits is a hot spot nowadays.So,I will expound this topic from four aspects in this study:The primary part: To expound the relative concepts in such aspects:the history and status quo of the drug clinical test,the contents of the testees' legal benefits,the purpose and significance of safeguarding the testees'benefits.The second part: To draw the outline of theory and practice framework of safeguard testees'benefits according to law in American,by review the generation history of important documents which related to the American drug clinical test and describe the safeguard measures of the testees'benefits in American.The third part: To reveal the status quo and the problems of safeguard testees'legal benefits in our country by analyze a typical case.The fourth and the fifth part: To contrast and analyze the safeguard measures of testees'benefits between China and American,draw lessons from American consummate testees'safeguard systems ,obtain its quintessence and remove its lousy,then find out the countermeasures in law which are fit for the conditions of our country, and raise feasible measures to protect the testees'benefits in law.
